@ Jolly. Hello. This is the most common problem that comes when you go at wanted with your personal car. I recommend to everybody to use the fastest pd cars like bullet/turismo/infernus because the suspects are not allowed to use “F” by script. Coming back to your questions, yes. If the suspect steals your car after you /ms him to surrender he will get w6 runner. 
 

You can find the rule in the general department rules at 13.1.12.

 

”13.1.12 To give wanted 1 for "theft" to a player, they must steal your personal vehicle, whether you are on a mission or not. If the suspect steals your vehicle (drives away with it), they will receive Wanted 6 runner without any other warnings.”
